Welcome to Factful! These Terms of Service ("Terms") govern your use of the Factful mobile application ("App") and related services. By downloading, installing, or using Factful, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Factful, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you must have parental consent to use the App.

2. Description of Service

Factful is a mobile application that delivers daily educational facts to users. We offer:

• Free Service: One daily fact delivered via push notification
• Premium Service: Up to five daily facts with category selection and additional features

3. User Accounts

To access certain features, you may need to create an account. You are responsible for:

• Providing accurate and current information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Premium Subscriptions

Subscription Terms

• Premium subscriptions are processed through Apple's App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings

Free Trials

If offered, free trial periods will automatically convert to paid subscriptions unless cancelled before the trial ends. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

5. Acceptable Use

You agree to use Factful only for lawful purposes and in accordance with these Terms. You may not:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Copy, distribute, or modify any part of the App without permission
• Use automated systems to access the App
• Reverse engineer or attempt to extract the source code

6. Content and Intellectual Property

Our Content

All facts, text, graphics, logos, and other content in Factful are owned by us or our licensors and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

User Content

Any feedback, suggestions, or other content you provide to us may be used by us without restriction or compensation to you.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using Factful, you consent to our privacy practices.

8. Disclaimers

Factful is provided "as is" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Continuous, uninterrupted, or error-free operation
• Accuracy or completeness of content

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of Factful.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of Factful or violation of these Terms.

11. Termination

We may terminate or suspend your access to Factful at any time, with or without cause or notice. You may stop using the App at any time. Upon termination:

• Your right to use the App ceases immediately
• We may delete your account and associated data
• Provisions that should survive termination will remain in effect

12. Updates and Changes

We may update the App and these Terms from time to time. Significant changes will be communicated through the App or via email. Your continued use after changes become effective constitutes acceptance of the new Terms.

13. Third-Party Services

Factful may integrate with third-party services (such as Apple's App Store). Your use of such services is subject to their respective terms and conditions.

14. Geographic Restrictions

Factful may not be available in all countries or regions. We make no representation that the App is appropriate or available for use in all locations.

15. Dispute Resolution

Any disputes arising from these Terms or your use of Factful will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of Factful.

By using Factful, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
